Tracy Morgan is still struggling with recovery after he survived a deadly car accident in June.

"He's really having a tough time," the 45-year-old comedian's New York lawyer Benedict P. Morelli told People.

Morelli added that the former "Saturday Night Live" star has been "struggling" since the June 7 six-car crash on the New Jersey Turnpike that left him in critical condition and killed his friend and fellow comedian James "Jimmy Mack" McNair, 62.

Morgan suffered a broken leg, nose and several ribs when the limo bus he was riding in was struck by a Walmart truck. Aside from him, three others also were injured, The Star-Ledger reported.

Morgan is currently undergoing at-home therapy following his release from a rehabilitation facility in July 12. And though he was recently photographed strolling around in New York City using a walker, he still heavily relies on a wheelchair and it may take more months before he can fully walk again.

"He's making incremental progress," said Morelli. "But they'll have to wait another month before they assess him cognitively."

Kevin Roper, 35, of Jonesboro, Ga., the driver of the Walmart tractor-trailer that hit the limo bus, pleaded not guilty to one count of death by auto and four counts of assault by auto on June 11, USA Today reported.

Morgan also sued Walmart in federal court in Newark in July, accusing the retailer of negligence in connection with the crash.

"Walmart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries," the court filing read, according to The Hollywood Reporter. "As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation."

Walmart president and CEO Bill Simon also issued a statement immediately after the accident.

"We are profoundly sorry that one of our trucks was involved. We are working quickly to understand what happened and are cooperating fully with law enforcement to aid their investigation," Simon said in a statement issued to the Los Angeles Times.

"If it's determined that our truck caused the accident, Walmart will take full responsibility," he added.  "Safety is our absolute highest priority."
